Terms of Service

1. Acceptance of Terms

By installing, accessing, or using SmartFeed (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and SmartFeed (“we,” “our,” or “us”).

2. Description of Service

SmartFeed is a Shopify application that synchronizes your product catalog with Google Merchant Center. The Service includes:

  • Automated product data synchronization between Shopify and Google Merchant Center
  • AI-powered product validation and optimization suggestions
  • Store audit and compliance checking against Google Shopping policies
  • Analytics and reporting on sync status and product health

3. Account Requirements

To use SmartFeed, you must:

  • Have an active Shopify store with a valid subscription
  • Have a Google account with access to Google Merchant Center
  • Authorize SmartFeed to access your Shopify store data and Google Merchant Center account
  • Be at least 18 years of age or the age of majority in your jurisdiction

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. User Responsibilities

You agree to:

  • Provide accurate and complete product data in your Shopify store
  • Comply with Google Merchant Center policies and Shopify’s terms of service
  • Not use the Service for any unlawful purpose or to sync prohibited products
  • Review and approve AI-generated suggestions before applying them to your listings
  • Maintain accurate and up-to-date account information

5. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by SmartFeed and protected by intellectual property laws. You retain full ownership of your product data and store content. By using the Service, you grant us a limited license to access and process your data solely for the purpose of providing the Service.

To the maximum extent permitted by law, SmartFeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of revenue or profits resulting from product listing issues
  • Google Merchant Center account suspensions or disapprovals
  • Inaccurate AI-generated suggestions or validation results
  • Service interruptions or data synchronization delays

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated validation or suggestions will be accurate or complete
  • Product listings will be approved by Google Merchant Center
  • The Service will meet all of your specific requirements

9. Termination

You may terminate your use of SmartFeed at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access to the Service if:

  • You violate these Terms
  • Your Shopify store is suspended or terminated
  • Required by law or to protect the security of the Service

Upon termination, your data will be handled as described in our Privacy Policy.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
